Proposition 1 — Abortion & Contraception
What does it do?
This ballot measure would amend the California Constitution to enshrine a fundamental right to reproductive freedom. That includes the right to choose to have an abortion and the right to choose or refuse contraceptives. Because these rights are already protected by state law, Prop. 1 is unlikely to have any financial impact on California, unless a court interpreted it as expanding the government’s obligation to pay for contraception and abortion procedures, which it already does for low-income residents.

Why is it on the ballot?
There is already a right to privacy guaranteed in the California Constitution, but it is not explicitly defined. Historically, the language has been understood to preserve reproductive rights, including through a decision by the California Supreme Court. Abortion and contraceptive access were later expressly protected in state law.

The U.S. Supreme Court decision in June overturning Roe v. Wade, however, has raised fears that a change in legal interpretation or partisan control of the now-overwhelmingly Democratic state Legislature could undermine those protections for Californians in the future.

Backed by abortion rights advocates and Gov. Gavin Newsom, lawmakers rushed to place Proposition 1 on the ballot to ensure that reproductive health care remains a constitutional right in California.

What are the arguments for and against?
For
Supporters argue that Proposition 1 will prevent California from going backwards on reproductive rights. By putting the right to abortion and contraceptions directly into the California Constitution, they say that reproductive health care will always be a medical decision, not a political one, no matter what party controls state government.

Opponents say that Prop. 1 is unnecessary to protect reproductive rights in California but is written so broadly that it could face years of protracted court battles to clear up the language, costing the state millions of dollars in legal fees. They raise particular concern that the measure would override state regulations that now limit abortions after the point when a fetus is viable on its own outside of the womb, at about 24 weeks of pregnancy. These late-term abortions are currently only legal if the health or life of the mother is threatened. Supporters say the measure does nothing to change that.

The voter filed a complaint with the Arizona secretary of state, who forwarded it to the US Department of Justice and the Arizona attorney general’s office for investigation, according to Sophia Solis, a spokesperson with the secretary of state’s office.

The incident allegedly occurred at a Mesa, Arizona, outdoor drop box on the evening of 17 October. Early voting, both in person and via mailed ballots, began on 12 October ahead of the midterm elections.

“There’s a group of people hanging out near the ballot drop box filming and photographing my wife and I as we approached the drop box and accusing us of being a mule. They took a photographs [sic] of our license plate and of us and then followed us out the parking lot in one of their cars continuing to film,” the voter wrote in the complaint.

In Arizona, voters can only drop off ballots for themselves, people in their households or families, or people they’re providing care for. Other states don’t ban so-called ballot harvesting. The practice became illegal in Arizona in 2016.

The incident comes as people in Maricopa and Yavapai counties have started to monitor drop boxes, spurred by the movie 2000 Mules, which makes unsubstantiated claims that “mules” are stuffing ballot boxes with votes. In other states, similar efforts to monitor drop boxes are under way, organized by people who remain convinced the 2020 presidential election was stolen.

The Maricopa drop boxes are already under video surveillance by the county and broadcast on a live feed on the county’s website, and the Yavapai drop boxes have cameras mounted on them.

Election officials and voter advocacy groups have warned that the practice could lead to voter intimidation. At a press conference in Phoenix on Wednesday, Maricopa county supervisor Bill Gates said people outside the Maricopa county tabulation and election center were approaching and photographing election workers as they went into the site to work.

“They’re harassing people. They’re not helping further the interests of democracy. If these people really wanna be involved in the process, learn more about it, come be a poll worker or a poll observer,” Gates said.

On Wednesday, a few people with cameras gathered outside a fence around the tabulation center’s parking lot and identified themselves to reporters as part of a group called Clean Elections USA. On its website, the group says it’s looking for “true Patriots to take a stand and watch the drop boxes” by gathering video and witnessing any potential “ballot tampering”.

In Yavapai county, groups that planned to organize drop box watches received legal warnings that they could be intimidating voters, halting their plans for coordinated watches, but some people are still watching the boxes from their cars, one of the groups, Lions of Liberty, told local TV station AZFamily.

Yavapai county sheriff David Rhodes issued a statement about drop box watching and voter intimidation this week, saying that the number of ballots a person drops off does not indicate a crime or suspicion of a crime. Arizona’s ballot collection law doesn’t specify how many ballots a person can drop off, just the people they can carry ballots for.

“It is difficult to know each voter’s circumstance so your behavior towards others attempting to cast ballots must not interfere with that person’s right to vote. Should your actions construe harassment or intimidation you may be breaking Arizona’s voter intimidation laws,” Rhodes wrote.

Election officials ask voters to report instances of harassment and intimidation to their local election offices or other authorities, so that those claims can be investigated.

Rep. Janel Brandtjen, the GOP chair of the state legislature's election committee, plus a veterans group sued last week, seeking a court order to pull aside such ballots. She was represented by Michael Gableman, who was fired by the Assembly Speaker Robin Vos after a months-long investigation failed to find evidence of wrongdoing during the 2020 election.

MADISON, Wis. (AP) — A Wisconsin judge on Monday, less than 14 hours before polls opened, refused to order that military absentee ballots be pulled aside and sequestered until it can be verified that they were cast legally, saying that would be a “drastic remedy" that could disenfranchise voters.

The Republican chair of the Wisconsin Assembly's elections committee along with a veterans group and other voters sued on Friday, seeking a court order to sequester the ballots.

Waukesha County Circuit Judge Michael Maxwell denied that request for a temporary restraining order in a ruling from the bench following a two-hour hearing Monday afternoon.

“That just seems to be a drastic remedy,” he said of sequestering the ballots.

The judge also denied a request from state Rep. Janel Brandtjen, who was represented by attorneys from the conservative Thomas More Society, to order the elections commission to withdraw its guidance to clerks about absentee ballots from members of the military. Brandtjen has pushed conspiracy theories about the 2020 election.

The judge said the case did raise questions about whether the bipartisan Wisconsin Elections Commission was adequately informing the state’s 1,800-plus election clerks about their duty to maintain a list of eligible military voters.

The lawsuit comes after a top Milwaukee County elections official was charged with fraudulently requesting three military ballots using fake names and having them sent to Brandtjen as way to expose vulnerabilities in Wisconsin elections. Kimberly Zapata, deputy director of the Milwaukee Election Commission, was fired last week and now faces charges of felony misconduct in office and three misdemeanor counts of election fraud.

Michael Gableman, a former Wisconsin Supreme Court justice who was hired by Republicans to investigate the 2020 election, now works for the Thomas More Society and represented Brandtjen. He argued that legitimate military absentee voters could have their votes negated by fraudulent ones, and the only way to prevent that was to sequester all the ballots to ensure they're valid.

“How else could we possibly ensure that only the authentic military ballots are counted?” Gableman said.

Lynn Lodahl, an assistant attorney general representing the elections commission, called that a “completely unworkable request” with no legal basis.

“There’s no process in the statutes for sequestration,” she said. "The plaintiffs don’t explain what this means. They don’t explain how this will work.”

Military ballots comprise a tiny fraction of all ballots cast in the state. On average, they represent about 0.07% of all absentee ballots requested, according to the Wisconsin Elections Commission. In the 2018 election, 2,700 military ballots were requested and as of Thursday, 2,747 military ballots had been requested for the current election.

In Wisconsin, military voters are not required to register to vote, meaning they don’t need to provide a photo ID to request an absentee ballot.

All absentee ballots must be received by the close of polls at 8 p.m. Tuesday in order to be counted. As of Sunday, more than 715,000 absentee ballots had been returned.

The Union Veterans Council, a constituency group of the AFL-CIO, intervened in the lawsuit. The group’s executive director, Will Attig, called the lawsuit a pointless “attack on people who are actively serving this country.”

Chris Yatchak, chair of the group’s Milwaukee chapter, said during a virtual news conference Monday that the lawsuit was an “outrageous attempt by a single individual to try and cast doubt on a free and fair election process.”

“I’m just appalled at this,” Yatchak said. ”It’s a disgusting act.”

The case is certain to increase the pressure on the bipartisan state elections commission, which Republican gubernatorial candidate Tim Michels has said he wants to eliminate if he wins Tuesday's election.

Gableman was fired from his investigatory job earlier this year by Republican Assembly Speaker Robin Vos after his work was widely ridiculed and did not present any evidence to overcome President Joe Biden's victory. He previously appeared in court representing Harry Wait, who was charged with election fraud and identity theft after requesting and receiving absentee ballots in the names of legislators and local officials in July.

An affidavit unsealed Monday charges Michael A. Yaker, of Village of Windsor, Wis., with sending emails threatening Evers on Oct. 27. It also says Yaker posted Facebook messages threatening the governor. And apparently it's not the first time he's made threats against public officials.

MADISON - A Dane County man with a history of making threats against public officials has been accused in federal court with threatening to kill Gov. Tony Evers.

Michael Yaker, 52, of DeForest, was charged last week after saying Evers is "a Dead Man Walking" and "Marked For Elimination" in emails to the governor. He later told a Wisconsin Capitol Police officer he would like to "have my hands around (Evers') throat, ... I'd like to bash his head against a Concrete Wall Till The Concrete Turns to Dust...I'd Like to have his Blood On My Hands I'd like to See His Blood Drain Down The Gutter I'd Like Have to have shares of his skull in my Medicine Bag,” according to the criminal complaint.

A spokeswoman for Evers declined to comment. The Daily Beast first reported on the charges, which were filed Friday.

Yaker, a timber framer profiled by the Milwaukee Journal Sentinel in 2009, was charged in 2011 for stalking Dane County clerk Scott McDonell, who was the county board chairman at the time, after Yaker did not win a contract to build a county park shelter, according to the Wisconsin State Journal. Yaker brought a large ax to the City-County Building in Madison to confront McDonell at a public forum being held there and sent threats by email, according to a 2011 State Journal story.

Yaker was fined after pleading no contest in January to disorderly conduct for sharpening his ax in front of the building, according to the State Journal.

Yaker is charged federally because he allegedly made the threats from Kansas, according to the Dane County Sheriff's detective who investigated the matter.

Court records filed in the Western District of Wisconsin indicate Yaker is facing a felony count of transmitting interstate communications "containing threats to harm." A warrant for Yaker remained sealed Monday.

The charges come as federal officials have warned about a rising threat environment for acts of political violence and the recent assault by a hammer-wielding attacker on Paul Pelosi, the husband of House Speaker Nancy Pelosi.

Apparently it had something to do with comments that an official heard one of them made and there were social media posts. From what I'm seeing online, it may had something to do with January 6th.

Fulton County election officials fired a poll worker and her son after they expressed concerns with social media posts.

The two workers were fired about 15 minutes before the polls opened at the Ocee Library. Fulton County Elections confirmed the workers are a mother and son.

The county’s elections interim director Nadine Williams said another worker overheard a comment made by the woman at a poll worker event. The peer also found social media posts made by the worker and reported them to the county.

“We sent that information to Secretary of State’s Office to ask if it should be under investigation for concern,” Williams said. “They also looked at the social media posts and said they agreed with the concern and that it’s our decision to remove.”

The county removed the workers until they can complete the investigation.

Williams said she could not comment on the nature of the posts, but the county “wanted to make sure the election was secure.”

“There were some things in there that were not allowed. You cannot take videos or photos in the election, so that’s what brought it to our attention,” Williams said.

Channel 2′s Michael Seiden reached out to Johns Creek police.

A spokeswoman confirmed that officers responded to the library after two poll workers refused to leave. When officers arrived, the two people left without any incidents. Police said there was no arrests or incident reports filed.
