......... but a working guy protecting himself sits in jail? (Update: After 5 Days, his bail was lowered and he's finally out)
Bodega Worker Jose Alba Stabs Austin Simon to Death Who Assaulted Him After His White Girlfriend Couldn’t Pay For Chips By Robert Littal
I am not sure why the bodega worker is in jail.
I have watched the graphic video, and it is clear that he feared for his life and was trapped in that situation. Austin Simon, a career criminal, had invaded his space and had already assaulted him before Alba stabbed him.
Alba’s intent wasn’t to kill him but to get out of the situation.
It is crazy that he is in jail now.
A hard-working Manhattan bodega clerk who was forced to grab a knife to fend off a violent ex-con, now finds himself sitting behind bars at the notorious Rikers Island jail charged with murder and unable to post $250,000 bail.
The sky-high bail for Jose Alba — who has no known criminal history — was just half of what controversial Manhattan District Attorney Alvin Bragg’s office demanded, despite surveillance video showing the clerk being assaulted by his alleged victim in the bodega.
Alba, 51, was charged with the fatal stabbing of Austin Simon, 35, who can be seen storming behind the counter at the Hamilton Heights Grocery on Broadway and West 139th Street to attack the store worker Friday night.
The harrowing incident followed an argument Alba had with Simon’s girlfriend, whose EBT debit card was declined when she tried to use it to buy chips for her 10-year-old daughter at the store, police and law enforcement sources said.
The 32-year-old woman claimed Alba grabbed the snack out of her daughter’s hand — so she knocked over items on the counter and ran home to get Simon, who stormed into the bodega and attacked Alba about 10 minutes later.
During the fight, Simon’s girlfriend allegedly stabbed the worker in the shoulder with a knife she had in her purse, according to Alba’s defense attorney — but she is not facing charges.
Simon, meanwhile, was already on parole for assaulting a cop at the time of the deadly encounter — and has at least eight prior busts, including for assault, robbery, and assault during a domestic dispute, sources and records show.

I may be old but I don't consider myself "elderly."
I'm also wondering if "51" is a typo since that dude looks way older than me and I'll be 56 in less than 2 weeks.

I don't consider 51 elderly either........and that guy does look more like he's 65-75.........either way, no physical threat to the younger idiot that decided to manhandle him.
So, Old Man........you hurting yourself just sleeping yet?

it just gets worse looking for this DA's side of things......... www.foxnews.com/opinion/crime-tipping-point-nyc-bodega-case-crackdown-criminals?fbclid=IwAR3EkT1_bwtnDxi-ZGVNByHwT-i6XEAC56vSL0hd1tDiPlEhZrgwurjXEW4That the incident, and Alba’s apparent efforts at self-defense, were caught on video fueled instantaneous outrage over the arrest – which only grew as new facts emerged. MCENANY SOUNDS OFF ON MURDER CHARGE AGAINST NYC BODEGA WORKER: ‘I FEEL LIKE I’M IN THE TWILIGHT ZONE' For one, Alba is by all accounts a longtime pillar of his community, a mild-mannered Dominican immigrant with no criminal record who works long hours. Simon, a 35-year-old violent career criminal with numerous felony arrests, was out on parole for assaulting a police officer. Then there is Manhattan DA Alvin Bragg’s treatment of Alba. Charged with second-degree murder, the highest murder count available (first-degree murder is reserved for rare cases like killing a cop or a witness), Alba was sent to New York’s notorious Rikers Island jail after the DA requested $500,000 bail (which the judge knocked down to $250,000). Meanwhile, Simon’s girlfriend, who told Alba, "I’m gonna bring my n----- down here and he gonna f--- you up," faces no charges, and Alba’s untreated stab wounds became infected at Rikers. Manhattan District Attorney Alvin Bragg (Barry Williams/New York Daily News/Tribune News Service via Getty Images) Under New York law, Alba was entitled to employ deadly force if he believed he was confronted by the same. He was threatened by Simon’s girlfriend and then attacked by Simon, who appeared to reach threateningly for his pocket at points. Alba, who told Simon, "Papa, I don’t want a problem, papa," clearly had no means to retreat as the assault began. So a viable and more prudent option for Bragg would have been to defer prosecution while gathering facts for submission to the grand jury. Instead, Bragg’s office charged intentional murder and requested high bail, for an accused with no criminal record and significant community ties. If the district attorney has other facts to counter what looks like a strong justification defense for Alba – which is always possible – those facts had better be game-changers. All this comes as fears grow that crime in major American cities is simply out of control, and residents have had enough. In San Francisco, DA Chesa Boudin was just recalled by referendum in that heavily Democratic city. In Los Angeles, over 700,000 signatures were just submitted for a referendum to recall DA George Gascon (567,000 are needed to trigger it). In Philadelphia, an effort to impeach DA Larry Krasner is underway. In Manhattan, Bragg entered office this year by issuing a notorious "reform" memo that instructed prosecutors to avoid jail time for all but the most serious crimes – all while crime was significantly up in New York over the prior year in nearly every major category (index crimes are up another 38% so far this year). What all these prosecutors share is a view of their mission as less law enforcement and more sociological tinkering, and all had their election campaigns funded by George Soros (Bragg’s to the tune of a reported $1 million).

You may not be elderly, but you've certainly taken great pains to experience what it's like. Besides, as unfair as it may sound, to some youngsters out there, anyone over 30 is an old fart. On the bright side, if you end up needing a walking cane after this, you'll be the teachers' version of House. Then all you'll need is to find Cuddy...

I'm very curious why the woman that started this entire event hasn't been charged in the death of that man?
If you're involved in a crime.......and someone ends up dead.......don't they usually hold you responsible for that death?
Seems the media needs to up their game once again.

Those are two different crimes, Kyle.

Apparently she tried to buy her kid some chips .........and her EBT was denied. So she threw a hissy, went and got her BF who returned with her to assault this guy behind the counter.
After the old guy used that blade in self-defense, she ended up landing a few knife stabs of her own on the old dude from behind. His lawyers said while he was held for 5 days, they didn't even give him proper medical care for those stab wounds.

So... NOT involved in the stabbing of her BF.
I don't know if that counts in the whole "felony murder" scheme of things.
