Tattoo shop owner arrested after sexual assault allegation

LAS CRUCES - A local tattoo artist and business owner was arrested after a woman came forward with allegations of rape.
Billy Porter, 38, stands charged with criminal sexual penetration, according to a criminal complaint filed in the Doña Ana County Magistrate Court. Porter is the owner of Porter House Ink, a tattoo and piercing shop on the 1200 block of East Lohman.
According to an affidavit written by Las Cruces Police Department Det. Diana Renteria, police believe that Porter was asked to do tattoo work when the assault occurred.
Renteria said that the 22-year-old woman said she and Porter met at the Hooters on the 3500 block of Foothills Road on May 19. That same day, the woman said Porter agreed to do a cover-up job (covering an unwanted tattoo with a new one) but that he would have to do it at her home.
The woman said she and Porter then left Hooters and arrived at her apartment, according to the affidavit. At that time, she told police that she began to feel sick and, once she got inside, threw up before going to her bed to lie down.
The woman told police that Porter then sexually assaulted her and forced an unknown white powdered substance into her nose. Renteria said in the affidavit that a SANE examination discovered several injuries consistent with experiencing rape.
Renteria also said that a doorbell security camera showed Porter, the woman, and another man entering the house around 4 p.m. on May 19. About 20 minutes later, the camera showed Porter and the other man leaving, Renteria said. The camera footage also showed the other man using a T-shirt to wipe down the door handle, Renteria said. Court records show that the second man has not been charged regarding his alleged involvement.
Six minutes after the two men leave, Renteria said that the woman's boyfriend arrived home from work. The boyfriend told police when he arrived, he found his girlfriend passed out on the bathroom floor.
After a first appearance in magistrate court on Monday, Porter was granted a $2,500 surety bond, meaning he'd have to pay 10 percent of that to get out of jail. Porter was ordered to have no contact with the woman and scheduled for another hearing at the end of the month.
